자본시장과 금융투자업에 관한 법률 제400조(채무변제순위)

① 거래소의 회원이 증권시장 또는 파생상품시장에서의 매매거래에 따른 채무를 이행하지 아니하여 거래소 또는 다른 회원에게 손해를 끼친 경우 그 손해를 입은 거래소 또는 다른 회원은 그 손해를 끼친 회원의 회원보증금ㆍ거래증거금 및 공동기금 지분에 대하여 다른 채권자보다 우선하여 변제받을 권리를 가진다.

(1) Where웨어 a어 member멤버 of어^v브 the^ð디 exchange익스체인지 fails^f페일즈 to투 perform퍼^f폼 obligations아블러게이션즈 from^f프^r럼 trading트^r레이딩 in인 the^ð더 securities시큐^r러티즈 market마킷 or오 the^ð더 derivatives더^r리^v버티^v브즈 market마킷 and앤드 thereby^ð데어바이 causes카지즈 loss로스 to투 the^ð디 exchange익스체인지 or오 another어너^ð더 member,멤버 the^ð디 exchange익스체인지 or오 other어^ð더 member멤버 that^ð댓 suffered서^f퍼드 the^ð더 loss로스 shall섈 have해^v브 the^ð더 right^r라잇 to투 be비 paid,페이드 in인 preference프^r레^f퍼^r런스 to투 other어^ð더 creditors,크^r레디터즈 out아웃 of어^v브 the^ð더 member멤버 guarantee게^r런티 deposit,더파짓 trading트^r레이딩 margin마전 and앤드 share셰어 in인 the^ð더 Joint조인트 Fund^f펀드 of어^v브 the^ð더 member멤버 that^ð댓 caused카즈드 the^ð더 loss.로스

② 거래소는 회원이 증권시장 또는 파생상품시장에서의 매매에 따른 결제를 위하여 납부한 대금ㆍ증권 및 품목에 관하여 다른 채권자보다 우선하여 변제를 받을 권리가 있다.

(2) The^ð디 exchange익스체인지 shall섈 have해^v브 the^ð더 right^r라잇 to투 be비 paid,페이드 in인 preference프^r레^f퍼^r런스 to투 other어^ð더 creditors,크^r레디터즈 out아웃 of어^v브 the^ð더 money,머니 securities시큐^r러티즈 and앤드 commodities커마더티즈 paid페이드 in인 by바이 a어 member멤버 for^f포 settlement세털먼트 of어^v브 trading트^r레이딩 in인 the^ð더 securities시큐^r러티즈 market마킷 or오 the^ð더 derivatives더^r리^v버티^v브즈 market.마킷

③ 거래소는 증권시장 또는 파생상품시장에서의 매매에 따른 결제완료 전에 대금ㆍ증권 및 품목이 인도된 경우에 해당 회원이 그 결제를 이행하지 아니함으로써 거래소에 손해를 끼친 때에는 그 회원의 재산에 관하여 다른 채권자보다 우선하여 변제를 받을 권리가 있다. 다만, 그 결제의 이행 기한이 도래하기 전에 설정된 전세권ㆍ질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 의하여 담보된 채권에 대하여는 우선하여 변제를 받을 권리가 없다. <개정 2010.6.10>

④ 제1항부터 제3항까지의 규정에 따른 거래소의 우선권은 제395조제3항에 따른 위탁자의 회원보증금에 대한 권리보다 우선하는 효력을 가진다.

(4) The^ð디 exchange's익스체인지즈 right^r라잇 of어^v브 priority프^r라이오^r러티 under언더 paragraphs패^r러그^r래^f프스 (1) through^θ쓰^r루 (3) shall섈 take테이크 precedence프^r레서든스 over오우^v버 the^ð더 rights^r라잇츠 of어^v브 consignors칸시뇨즈 to투 the^ð더 member멤버 guarantee게^r런티 deposit더파짓 under언더 Article아터클 395 (3).
