재난 및 안전관리 기본법 제60조(특별재난지역의 선포)

① 중앙대책본부장은 대통령령으로 정하는 규모의 재난이 발생하여 국가의 안녕 및 사회질서의 유지에 중대한 영향을 미치거나 피해를 효과적으로 수습하기 위하여 특별한 조치가 필요하다고 인정하거나 제5항에 따른 지역대책본부장의 요청이 타당하다고 인정하는 경우에는 중앙위원회의 심의를 거쳐 해당 지역을 특별재난지역으로 선포할 것을 대통령에게 건의할 수 있다. <개정 2025.4.1>

② 제1항에도 불구하고 대규모 인명피해가 발생하는 등 시급하게 특별재난지역으로 선포할 필요가 있는 경우로서 중앙대책본부장의 요청(제14조제4항에 따라 국무총리가 중앙대책본부장의 권한을 행사하는 경우는 제외한다)을 받아 중앙위원회의 심의를 거칠 시간적 여유가 없다고 중앙위원회의 위원장이 인정하는 경우 중앙대책본부장은 중앙위원회의 심의를 거치지 아니하고 해당 지역을 특별재난지역으로 선포할 것을 대통령에게 건의할 수 있다. <신설 2025.4.1>

③ 제1항에 따라 대통령령으로 재난의 규모를 정할 때에는 다음 각 호의 사항을 고려하여야 한다. <신설 2024.1.16, 2025.4.1>

⑤ 지역대책본부장은 관할지역에서 발생한 재난으로 인하여 제1항에 따른 사유가 발생한 경우에는 중앙대책본부장에게 특별재난지역의 선포 건의를 요청할 수 있다. <개정 2024.1.16, 2025.4.1>
