재난 및 안전관리 기본법 제66조의11(지역축제 개최 시 안전관리조치)

① 중앙행정기관의 장 또는 지방자치단체의 장은 대통령령으로 정하는 지역축제를 개최하려면 해당 지역축제가 안전하게 진행될 수 있도록 지역축제 안전관리계획을 수립하고, 그 밖에 안전관리에 필요한 조치를 하여야 한다. 다만, 다중의 참여가 예상되는 지역축제로서 개최자가 없거나 불분명한 경우에는 참여 예상 인원의 규모와 장소 등을 고려하여 대통령령으로 정하는 바에 따라 관할 지방자치단체의 장이 지역축제 안전관리계획을 수립하고 그 밖에 안전관리에 필요한 조치를 하여야 한다. <개정 2023.12.26>

② 행정안전부장관 또는 시ㆍ도지사는 제1항에 따른 지역축제 안전관리계획의 이행 실태를 지도ㆍ점검할 수 있으며, 점검결과 보완이 필요한 사항에 대해서는 관계 기관의 장에게 시정을 요청할 수 있다. 이 경우 시정 요청을 받은 관계 기관의 장은 특별한 사유가 없으면 요청에 따라야 한다. <개정 2014.11.19, 2017.7.26>

③ 중앙행정기관의 장 또는 지방자치단체의 장 외의 자가 대통령령으로 정하는 지역축제를 개최하려는 경우에는 해당 지역축제가 안전하게 진행될 수 있도록 지역축제 안전관리계획을 수립하여 대통령령으로 정하는 바에 따라 관할 시장ㆍ군수ㆍ구청장에게 사전에 통보하고, 그 밖에 안전관리에 필요한 조치를 하여야 한다. 지역축제 안전관리계획을 변경하려는 때에도 또한 같다. <신설 2019.12.3>

④ 제3항에 따른 통보를 받은 관할 시장ㆍ군수ㆍ구청장은 필요하다고 인정되는 때에는 지역축제 안전관리계획에 대하여 보완을 요구할 수 있다. 이 경우 보완을 요구받은 자는 정당한 사유가 없으면 이에 따라야 한다. <신설 2019.12.3>

⑤ 제1항 또는 제3항에 따른 지역축제의 안전관리를 위하여 필요한 경우 중앙행정기관의 장 또는 지방자치단체의 장(제3항에 따른 지역축제의 경우에는 관할 시장ㆍ군수ㆍ구청장을 말한다. 이하 이 항 및 제6항에서 같다)은 관할 경찰관서, 소방관서 및 그 밖에 관계 기관의 장에게 협조 또는 해당 기관의 소관 사항에 대한 역할 분담을 요청할 수 있다. 이 경우 요청을 받은 기관의 장은 특별한 사유가 없으면 이에 따라야 한다. <신설 2023.12.26>

⑥ 제1항 또는 제3항에 따른 지역축제의 안전관리를 위하여 필요한 경우 중앙행정기관의 장 또는 지방자치단체의 장은 대통령령으로 정하는 바에 따라 관할 경찰관서, 소방관서 및 그 밖에 관계 기관ㆍ단체 등이 참여하는 지역안전협의회를 구성ㆍ운영할 수 있다. <신설 2023.12.26>
