재난 및 안전관리 기본법 제76조의5(재난취약시설 보험ㆍ공제의 가입 등)

② 다음 각 호에 해당하는 시설 중 대통령령으로 정하는 시설(이하 "재난취약시설"이라 한다)을 소유ㆍ관리 또는 점유하는 자는 해당 시설에서 발생하는 화재, 붕괴, 폭발 등으로 인한 타인의 생명ㆍ신체나 재산상의 손해를 보상하기 위하여 보험 또는 공제에 가입하여야 한다. 이 경우 다른 법률에 따라 그 손해의 보상내용을 충족하는 보험 또는 공제에 가입한 경우에는 이 법에 따른 보험 또는 공제에 가입한 것으로 본다. <신설 2016.1.7, 2017.1.17, 2020.6.9, 2023.12.26>

④ 행정안전부장관은 제2항에 따른 보험 또는 공제의 가입관리 업무를 위하여 필요한 경우 대통령령으로 정하는 바에 따라 중앙행정기관의 장 또는 지방자치단체의 장에게 행정적 조치를 하도록 요청하거나 관계 행정기관, 보험회사 및 보험 관련 단체에 보험 또는 공제의 가입관리 업무에 필요한 자료를 요청할 수 있다. 이 경우 요청을 받은 자는 정당한 사유가 없으면 이에 따라야 한다. <신설 2016.1.7, 2017.7.26, 2020.6.9>

⑤ 보험사업자는 재난취약시설을 소유ㆍ관리 또는 점유하는 자(이하 "재난취약시설소유자등"이라 한다)가 제2항 전단에 따른 보험 또는 공제(이하 "재난취약시설보험등"이라 한다)에 가입하려는 때에는 계약의 체결을 거부할 수 없다. 다만, 재난취약시설소유자등이 영업정지 처분을 받아 재난취약시설을 본래의 사용 목적으로 더 이상 사용할 수 없게 된 경우 등 대통령령으로 정하는 경우에는 그러하지 아니하다. <신설 2023.12.26>

⑥ 재난취약시설에서 화재가 발생할 개연성이 높은 경우 등 대통령령으로 정하는 사유가 있는 경우에는 다수의 보험사업자가 공동으로 재난취약시설보험등의 계약을 체결할 수 있다. 이 경우 보험사업자는 해당 재난취약시설소유자등에게 공동계약체결의 절차 및 보험료ㆍ공제회비 등에 대한 안내를 하여야 한다. <신설 2023.12.26>
