저작권법 제35조의3(부수적 복제 등)

사진촬영, 녹음 또는 녹화(이하 이 조에서 "촬영등"이라 한다)를 하는 과정에서 보이거나 들리는 저작물이 촬영등의 주된 대상에 부수적으로 포함되는 경우에는 이를 복제ㆍ배포ㆍ공연ㆍ전시 또는 공중송신할 수 있다. 다만, 그 이용된 저작물의 종류 및 용도, 이용의 목적 및 성격 등에 비추어 저작재산권자의 이익을 부당하게 해치는 경우에는 그러하지 아니하다.
