배타적발행권이 그 존속기간의 만료 그 밖의 사유로 소멸된 경우에는 그 배타적발행권을 가지고 있던 자는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 그 배타적발행권의 존속기간 중 만들어진 복제물을 배포할 수 없다. <개정 2011.12.2>
