전기통신사업법 시행령 제37조의6(전기통신역무 제공 중지 이의신청의 절차)

① 법 제32조의3제1항제5호에 따른 요청으로 전기통신역무 제공이 중지된 이용자는 이의신청을 하려면 전기통신역무 제공이 중지된 날부터 30일 이내에 다음 각 호의 사항을 적은 신청서를 전기통신역무 제공의 중지를 요청한 수사기관의 장에게 제출해야 한다.

(1) A어 user유저 whose후즈 telecommunications텔러커뮤너케이션즈 services서^v버시즈 have해^v브 been빈 suspended서스펜디드 upon어판 a어 request^r리퀘스트 under언더 Article아터클 32-3 (1) 5 of어^v브 the^ð디 Act액트 and앤드 who후 intends인텐즈 to투 file^f파일 an앤 objection어브젝션 shall,섈 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð더 provision프^r러^v비전 of어^v브 telecommunications텔러커뮤너케이션즈 services서^v버시즈 was워즈 suspended,서스펜디드 submit서브밋 an앤 application애플러케이션 stating스테이팅 the^ð더 following^f팔로잉 matters매터즈 to투 the^ð더 head헤드 of어^v브 the^ð디 investigative인^v베스터게이티^v브 agency에이전시 that^ð댓 requested^r리퀘스티드 the^ð더 suspension:서스펜션

② 제1항에 따라 신청을 받은 수사기관의 장(이하 "수사기관의 장"이라 한다)은 이의신청을 받은 날부터 15일 이내에 해당 이의신청에 대한 결과를 이의신청인에게 서면으로 통지해야 한다. 다만, 부득이한 사유로 15일 이내에 결정을 할 수 없을 때에는 15일의 범위에서 그 기간을 연장할 수 있으며, 연장사유와 연장기간을 이의신청인에게 통지해야 한다.

③ 수사기관의 장은 제1항에 따라 제출된 신청서의 보완이 필요한 경우 보완이 필요한 내용과 보완기간을 명시하여 서면으로 보완을 요청할 수 있다. 이 경우 그 보완에 걸린 기간은 제2항 본문의 기간에 산입하지 않는다.

④ 수사기관의 장은 이의신청이 이유가 있다고 인정할 때에는 지체없이 과학기술정보통신부장관에게 해당 전기통신역무 제공의 중지를 해제하도록 요청해야 한다.
