전기통신사업법 시행령 제39조의2(설비등의 장치 부착에 관한 절차)

① 법 제35조제4항 전단에 따라 법 제35조제1항에 따른 협정을 체결하여 설비등을 제공받은 전기통신사업자(이하 이 조에서 "이용사업자"라 한다)가 해당 설비등의 효율성을 높이는 장치를 부착하려는 때에는 장치를 부착하려는 날의 1일 전까지 해당 설비등을 제공하는 기간통신사업자 또는 시설관리기관(이하 이 조에서 "제공사업자"라 한다)에 다음 각 호의 내용을 통보하여야 한다.

② 제1항에 따라 장치를 부착한 이용사업자는 법 제35조제1항에 따른 협정이 해지되거나 장치의 부착 기간이 종료된 날부터 30일 이내에 그 장치를 제거하여야 한다.

(2) A어 user유저 operator아퍼^r레이터 that^ð댓 has해즈 attached어태치트 a어 device디^v바이스 under언더 paragraph패^r러그^r래^f프 (1) shall섈 remove^r리무^v브 the^ð더 device디^v바이스 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð디 agreement어그^r리먼트 under언더 Article아터클 35 (1) of어^v브 the^ð디 Act액트 is이즈 terminated터머네이티드 or오 the^ð더 period피^r리어드 of어^v브 attachment어태치먼트 ends.엔즈

③ 제1항 및 제2항에도 불구하고 이용사업자와 제공사업자가 협의하여 장치의 통보 기간ㆍ내용 또는 제거 기간 등을 달리 정한 경우에는 그에 따른다.
