Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, Article 38 (Calculation, etc. of Sales Related to Violations for Imposing Penalty Surcharges)
① 법 제34조제1항 전단에서 "대통령령으로 정하는 위반행위 관련 매출액"이란 다음 각 호의 어느 하나에 해당하는 금액을 말한다. 다만, 해당 위반행위가 제1호부터 제3호까지의 규정 가운데 둘 이상에 해당하는 경우에는 그 중 큰 금액을 말한다.
(1) "Sales related to the violation prescribed by Presidential Decree" in the former part of Article 34 (1) of the Act means any of the following amounts: Provided, That where the violation falls under two or more of subparagraphs 1 through 3, it means the largest of those amounts:
1. 해당 위반행위가 매출이나 소비자피해 발생의 직접적인 원인이 아닌 경우: 해당 위반행위의 발생시점으로부터 그 종료시점(해당 행위가 과징금부과 처분 시까지 종료되지 아니한 경우에는 과징금 부과처분을 명하는 공정거래위원회의 의결일을 해당 행위의 종료일로 본다)까지의 매출액의 100분의 10에 해당하는 금액. 다만, 위반행위가 특정 분야에 한정된 경우에는 해당 분야 매출액을 기준으로 한다.
1. Where the violation was not a direct cause of sales or consumer damage: an amount equal to 10/100 of the sales from the time the violation began until the time it ended (where the act has not ended by the time of the disposition imposing the penalty surcharge, the date of the Fair Trade Commission's resolution ordering the imposition of the penalty surcharge is deemed the date the act ended): Provided, That where the violation is limited to a particular field, the sales in that field shall be the basis;
2. 해당 위반행위가 매출이 일어난 직접적 원인이 된 경우: 해당 위반행위와 상당인과관계가 있는 매출액 전액에 해당하는 금액
2. Where the violation was a direct cause of sales: an amount equal to the full amount of sales that have an adequate causal relationship with the violation;
3. 해당 위반행위가 소비자피해에 직접적 원인이 된 경우: 해당 위반행위로 인하여 피해가 발생한 매출액 전액에 해당하는 금액
3. Where the violation was a direct cause of consumer damage: an amount equal to the full amount of sales in which damage occurred because of the violation.
② 법 제34조제1항에 따른 과징금의 부과기준은 별표 2와 같다.
(2) The standards for imposing penalty surcharges under Article 34 (1) of the Act shall be as set out in Attached Table 2.
③ 공정거래위원회는 이 영에서 규정한 사항 외에 과징금의 부과에 필요한 세부 기준을 정하여 고시할 수 있다.
(3) Other than the matters provided in this Decree, the Fair Trade Commission may determine and publicly notify the detailed standards necessary for imposing penalty surcharges.
