Act on Consumer Protection in Electronic Commerce, Article 9-2 (Responsibilities of Electronic Bulletin Board Service Providers)

① 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제9호의 게시판을 운영하는 같은 항 제3호의 정보통신서비스 제공자(이하 "전자게시판서비스 제공자"라 한다)는 해당 게시판을 이용하여 통신판매 또는 통신판매중개가 이루어지는 경우 이로 인한 소비자피해가 발생하지 아니하도록 다음 각 호의 사항을 이행하여야 한다.

1. 게시판을 이용하여 통신판매 또는 통신판매중개를 업으로 하는 자(이하 "게시판 이용 통신판매업자등"이라 한다)가 이 법에 따른 의무를 준수하도록 안내하고 권고할 것

2. 게시판 이용 통신판매업자등과 소비자 사이에 이 법과 관련하여 분쟁이 발생한 경우 소비자의 요청에 따라 제33조에 따른 소비자피해 분쟁조정기구에 소비자의 피해구제신청을 대행하는 장치를 마련하고 대통령령으로 정하는 바에 따라 운영할 것

3. 그 밖에 소비자피해를 방지하기 위하여 필요한 사항으로서 대통령령으로 정하는 사항

② 전자게시판서비스 제공자는 게시판 이용 통신판매업자등에 대하여 제13조제1항제1호 및 제2호의 신원정보를 확인하기 위한 조치를 취하여야 한다.

③ 전자게시판서비스 제공자는 게시판 이용 통신판매업자등과 소비자 사이에 분쟁이 발생하는 경우 다음 각 호의 어느 하나에 해당하는 자의 요청에 따라 제2항에 따른 신원 확인 조치를 통하여 얻은 게시판 이용 통신판매업자등의 신원정보를 제공하여 그 분쟁의 해결에 협조하여야 한다.
