Act on Promotion of Information and Communications Network Utilization and Information Protection, Article 44-13 (Measures against Abuse of Reporting)
대규모 정보통신서비스 제공자는 명백히 근거 없는 신고를 빈번하게 하는 등 신고 제도를 남용한다고 판단한 경우에는 해당 신고자에 대하여 사전 통지 후 다음 각 호의 사항을 고려하여 결정한 합리적인 기간 동안 제44조의12제1항에 따른 신고를 접수하지 아니할 수 있다.
Where a large-scale information and communications service provider determines that a reporter abuses the reporting system, such as by frequently making clearly groundless reports, it may, after giving prior notice, refuse to accept reports under Article 44-12 (1) from that reporter for a reasonable period determined in consideration of the following matters:
1. 제44조의12제6항에 따라 수립한 자율적인 운영정책에 따른 일정 기간 동안 명백히 근거 없이 신고하였다고 판단된 신고의 수
1. The number of reports determined to have been made clearly without grounds during a certain period under the voluntary operating policy established under Article 44-12 (6);
2. 제1호에 따른 기간 동안 제공된 정보 또는 신고된 정보의 전체 건수 중 제1호에 따른 신고비율
2. The ratio of the reports under subparagraph 1 to the total number of pieces of information provided or reported during the period under subparagraph 1;
3. 불법정보 또는 허위조작정보의 성격과 신고 남용의 결과가 피해자와 사회에 영향을 미치는 정도
3. The nature of the illegal information or false or manipulated information, and the extent to which the consequences of the abuse of reporting affect victims and society;
4. 신고자의 의도
4. The intent of the reporter.
