정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제15조(정신건강복지센터의 설치 및 운영)

① 보건복지부장관은 필요한 지역에서의 제12조제1항에 따른 소관 정신건강증진사업등의 제공 및 연계 사업을 전문적으로 수행하게 하기 위하여 정신건강복지센터를 설치ㆍ운영할 수 있다.

② 시ㆍ도지사는 관할 구역에서의 제12조제2항에 따른 소관 정신건강증진사업등의 제공 및 연계 사업을 전문적으로 수행하게 하기 위하여 광역정신건강복지센터를 설치ㆍ운영할 수 있다.

③ 시장ㆍ군수ㆍ구청장은 관할 구역에서의 제12조제3항에 따른 소관 정신건강증진사업등의 제공 및 연계 사업을 전문적으로 수행하게 하기 위하여 「지역보건법」에 따른 보건소(이하 "보건소"라 한다)에 기초정신건강복지센터를 설치ㆍ운영할 수 있다.

④ 정신건강복지센터의 장은 정신건강증진사업등의 제공 및 연계사업을 수행하기 위하여 정신질환자를 관리하는 경우에 정신질환자 본인이나 제39조에 따른 보호의무자(이하 "보호의무자"라 한다)의 동의를 받아야 한다.

⑤ 보건복지부장관은 제2항 및 제3항에 따른 정신건강복지센터의 설치ㆍ운영에 필요한 비용의 일부를 부담한다.

(5) The^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 shall섈 bear베어 part파트 of어^v브 the^ð더 costs카스츠 necessary네서세^r리 for^f포 establishing이스태블리슁 and앤드 operating아퍼^r레이팅 mental멘틀 health헬^θ스 welfare웰^f페어 centers센터즈 under언더 paragraphs패^r러그^r래^f프스 (2) and앤드 (3).

⑥ 보건복지부장관은 대통령령으로 정하는 바에 따라, 시ㆍ도지사 및 시장ㆍ군수ㆍ구청장은 조례나 규칙으로 정하는 바에 따라 소관 정신건강증진사업등을 정신건강에 관한 전문성이 있는 기관ㆍ단체에 위탁하여 수행할 수 있다.

(6) The^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare,웰^f페어 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree,디크^r리 and앤드 Mayors/Do메이어즈 Governors거^v버너즈 and앤드 heads헤즈 of어^v브 Si/Gun/Gu,시 as애즈 prescribed프^r리스크^r라이브드 by바이 ordinance오더넌스 or오 rule,^r룰 may메이 entrust엔트^r러스트 the^ð더 mental멘틀 health헬^θ스 promotion프^r러모우션 projects,프^r라젝츠 etc.엣세터^r러 under언더 their^ð데어 jurisdiction주^r러스딕션 to투 institutions인스티투션즈 or오 organizations오거너제이션즈 with위^ð드 expertise엑스퍼티즈 in인 mental멘틀 health.헬^θ스

⑦ 시ㆍ도지사는 소관 광역정신건강복지센터의 운영 현황 및 정신건강증진사업등의 추진 내용을, 시장ㆍ군수ㆍ구청장은 관할 시ㆍ도지사를 통하여 소관 기초정신건강복지센터의 운영 현황 및 정신건강증진사업등의 추진 내용을 각각 반기별로 보건복지부장관에게 통보하여야 한다. <개정 2024.9.20>

⑧ 보건복지부장관, 시ㆍ도지사 및 시장ㆍ군수ㆍ구청장은 수시로 신고를 받을 수 있는 정신건강상담용 긴급전화를 설치ㆍ운영하여야 한다. <신설 2019.4.23>

(8) The^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare,웰^f페어 Mayors/Do메이어즈 Governors,거^v버너즈 and앤드 heads헤즈 of어^v브 Si/Gun/Gu시 shall섈 establish이스태블리시 and앤드 operate아퍼^r레잇 an앤 emergency이머전시 telephone텔러^f폰 line라인 for^f포 mental멘틀 health헬^θ스 counseling카운설링 that^ð댓 can캔 receive^r러시^v브 reports^r리포츠 at앳 any에니 time.타임

⑨ 제1항부터 제7항까지에서 규정한 사항 외에 정신건강복지센터의 설치ㆍ운영에 필요한 사항 및 제8항에 따른 긴급전화의 설치ㆍ운영에 필요한 사항은 대통령령으로 정한다. <개정 2019.4.23>
