정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제76조(작업치료)

① 정신의료기관등의 장은 입원등을 한 사람의 치료, 재활 및 사회적응에 도움이 된다고 인정되는 경우에는 그 사람의 건강상태와 위험성을 고려하여 보건복지부령으로 정하는 작업을 시킬 수 있다.

② 제1항에 따른 작업은 입원등을 한 사람 본인이 신청하거나 동의한 경우에만 정신건강의학과전문의가 지시하는 방법에 따라 시켜야 한다. 다만, 정신요양시설의 경우에는 정신건강의학과전문의의 지도를 받아 정신건강전문요원이 작업의 구체적인 방법을 지시할 수 있다.
