정치자금법 제19조(후원회의 해산 등)

①후원회는 해당 후원회지정권자가 해산, 그 밖의 사유로 소멸하거나 후원회를 둘 수 있는 자격을 상실하거나 후원회의 지정을 철회한 때 또는 정관 등에 정한 해산사유가 발생한 때에는 해산한다. 다만, 후원회를 둔 중앙당창당준비위원회가 정당으로 등록하거나 후원회를 둔 국회의원후보자 또는 지방의회의원후보자가 각각 국회의원 또는 지방의회의원으로 당선된 경우에는 그 후원회는 대의기관이나 수임기관의 존속결의로써 등록된 중앙당, 당선된 국회의원 또는 당선된 지방의회의원의 후원회로 존속할 수 있으며, 국회의원당선인후원회ㆍ지방의회의원당선인후원회는 국회의원후원회ㆍ지방의회의원후원회로, 후원회를 둔 대통령예비후보자ㆍ국회의원예비후보자ㆍ지방의회의원예비후보자ㆍ지방자치단체장예비후보자가 대통령후보자ㆍ국회의원후보자ㆍ지방의회의원후보자ㆍ지방자치단체장후보자로 등록된 때에는 그 대통령예비후보자후원회ㆍ국회의원예비후보자후원회ㆍ지방의회의원예비후보자후원회ㆍ지방자치단체장예비후보자후원회는 대통령후보자후원회ㆍ국회의원후보자후원회ㆍ지방의회의원후보자후원회ㆍ지방자치단체장후보자후원회로 본다. <개정 2008.2.29, 2017.6.30, 2021.1.5, 2024.2.20>

②제1항 단서의 경우에 중앙당후원회ㆍ국회의원후보자후원회 및 지방의회의원후보자후원회의 대표자는 그 존속결의가 있은 날부터 14일 이내에 제7조(후원회의 등록신청 등)제4항의 규정에 의한 변경등록을 신청하여야 하며, 그 후원회는 종전의 후원회의 권리ㆍ의무를 승계한다. <개정 2008.2.29, 2017.6.30, 2024.2.20>

③후원회가 해산한 때에는 그 대표자는 14일 이내에 그 사실을 관할 선거관리위원회에 신고하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다. <개정 2008.2.29, 2010.1.25, 2012.2.29, 2016.1.15, 2021.1.5, 2024.2.20>

④후원회가 해산일부터 14일 이내에 제3항 본문의 규정에 의한 해산신고를 하지 아니한 경우에는 관할 선거관리위원회는 그 후원회의 등록을 말소할 수 있다.
