Parking Lot Act, Article 19-23 (Detailed Safety Inspections of Mechanical Parking Lots)

① 기계식주차장관리자등은 해당 기계식주차장이 다음 각 호의 어느 하나에 해당하는 경우에는 시장ㆍ군수 또는 구청장이 실시하는 정밀안전검사를 받아야 한다. 이 경우 제3호에 해당하는 때에는 정밀안전검사를 받은 날부터 4년마다 정기적으로 정밀안전검사를 받아야 한다. <개정 2023.8.16>

1. 제19조의9제2항에 따른 검사 결과 결함원인이 불명확하여 사고예방과 안전성 확보를 위하여 정밀안전검사가 필요하다고 인정된 경우

2. 기계식주차장의 이용자가 죽거나 다치는 등 국토교통부령으로 정하는 중대한 사고가 발생한 경우. 다만, 시장ㆍ군수ㆍ구청장이 사고조사반의 조사 등을 검토한 결과 사고의 원인이 기계식주차장치의 결함에 의한 것이 아닌 경우로서 구동부의 부품, 운반기 등 주요 주차장치의 파손이 없고, 안전에 문제가 없다고 판단하는 경우 등 국토교통부령으로 정하는 사항에 해당하는 경우에는 제외한다.

② 기계식주차장관리자등은 제1항에 따른 정밀안전검사에 불합격한 기계식주차장을 운영할 수 없으며, 다시 운영하기 위해서는 정밀안전검사를 다시 받아야 한다.

③ 제1항에 따라 정밀안전검사를 받은 경우 또는 정밀안전검사를 받아야 하는 경우에는 제19조의9제2항제2호에 따른 해당 연도의 정기검사를 면제한다.

⑤ 정밀안전검사에 관해서는 제19조의10제1항ㆍ제2항 및 제19조의11을 준용한다. 이 경우 "제19조의9제2항에 따른 검사", "제19조의9제2항 각 호에 따른 검사"는 "제19조의23제1항에 따른 정밀안전검사"로 본다. <개정 2017.10.24>

⑥ 제1항에 따른 정밀안전검사의 기준ㆍ항목ㆍ방법 및 실시시기 등에 필요한 사항은 대통령령으로 정한다.
