주택법 제62조(사용검사 후 매도청구 등)

① 주택(복리시설을 포함한다. 이하 이 조에서 같다)의 소유자들은 주택단지 전체 대지에 속하는 일부의 토지에 대한 소유권이전등기 말소소송 등에 따라 제49조의 사용검사(동별 사용검사를 포함한다. 이하 이 조에서 같다)를 받은 이후에 해당 토지의 소유권을 회복한 자(이하 이 조에서 "실소유자"라 한다)에게 해당 토지를 시가로 매도할 것을 청구할 수 있다.

② 주택의 소유자들은 대표자를 선정하여 제1항에 따른 매도청구에 관한 소송을 제기할 수 있다. 이 경우 대표자는 주택의 소유자 전체의 4분의 3 이상의 동의를 받아 선정한다.

(2) Owners오우너즈 of어^v브 housing하우징 may메이 select설렉트 a어 representative^r레프^r러젠터티^v브 and앤드 file^f파일 a어 lawsuit로숫 concerning컨서닝 a어 demand디맨드 for^f포 sale세일 under언더 paragraph패^r러그^r래^f프 (1). In인 this^ð디스 case,케이스 the^ð더 representative^r레프^r러젠터티^v브 shall섈 be비 selected설렉티드 with위^ð드 the^ð더 consent컨센트 of어^v브 at앳 least리스트 three-fourths^θ쓰^r리-^f포^θ쓰 of어^v브 all올 the^ð디 owners오우너즈 of어^v브 the^ð더 housing.하우징

③ 제2항에 따른 매도청구에 관한 소송에 대한 판결은 주택의 소유자 전체에 대하여 효력이 있다.

(3) A어 judgment저지먼트 in인 a어 lawsuit로숫 concerning컨서닝 a어 demand디맨드 for^f포 sale세일 under언더 paragraph패^r러그^r래^f프 (2) shall섈 be비 effective이^f펙티^v브 for^f포 all올 owners오우너즈 of어^v브 the^ð더 housing.하우징

④ 제1항에 따라 매도청구를 하려는 경우에는 해당 토지의 면적이 주택단지 전체 대지 면적의 5퍼센트 미만이어야 한다.

(4) To투 make메이크 a어 demand디맨드 for^f포 sale세일 under언더 paragraph패^r러그^r래^f프 (1), the^ð디 area에^r리아 of어^v브 the^ð더 land랜드 concerned컨선드 shall섈 be비 less레스 than^ð댄 5 percent퍼센트 of어^v브 the^ð더 total토우틀 site사잇 area에^r리아 of어^v브 the^ð더 housing하우징 complex.캄플렉스

⑤ 제1항에 따른 매도청구의 의사표시는 실소유자가 해당 토지 소유권을 회복한 날부터 2년 이내에 해당 실소유자에게 송달되어야 한다.

⑥ 주택의 소유자들은 제1항에 따른 매도청구로 인하여 발생한 비용의 전부를 사업주체에게 구상(求償)할 수 있다.

(6) Owners오우너즈 of어^v브 housing하우징 may메이 seek식 reimbursement^r리임버스먼트 from^f프^r럼 the^ð더 project프^r라젝트 proponent프^r러포우넌트 for^f포 all올 costs카스츠 incurred인커드 because비코즈 of어^v브 a어 demand디맨드 for^f포 sale세일 under언더 paragraph패^r러그^r래^f프 (1).
