지방세법 시행령 제128조의2(자동차등록번호판의 영치 일시 해제)

① 납세의무자는 법 제131조제2항에 따른 자동차등록번호판의 영치 일시 해제를 신청하려는 경우 행정안전부령으로 정하는 신청서에 같은 항에 따른 일시 해제의 사유가 있음을 증명하는 자료를 첨부하여 시장ㆍ군수ㆍ구청장에게 제출해야 한다. 자동차등록번호판 영치 일시 해제 기간의 연장을 신청하려는 경우에도 또한 같다.

② 특별시장ㆍ광역시장ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 법 제131조제2항에 따라 자동차등록번호판의 영치를 일시 해제하는 경우 그 기간을 6개월 이내로 해야 한다. 이 경우 그 기간이 만료될 때까지 법 제131조제2항에 따른 일시 해제의 사유가 해소되지 않은 경우에는 1회에 한정하여 3개월의 범위에서 그 기간을 연장할 수 있다.

③ 특별시장ㆍ광역시장ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제2항에 따라 자동차등록번호판의 영치를 일시 해제하거나 일시 해제 기간을 연장하는 경우 필요한 때에는 체납된 자동차세를 분할납부할 것을 조건으로 붙일 수 있다. 이 경우 분할납부의 기간은 자동차등록번호판의 영치 일시 해제 기간 또는 일시 해제 기간을 연장한 기간으로 하고, 분할납부의 횟수는 납세의무자의 자동차 사용목적과 생계유지의 관련성 등을 고려하여 해당 특별시장ㆍ광역시장ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 정한다.

④ 특별시장ㆍ광역시장ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 다음 각 호의 어느 하나에 해당하는 경우에는 자동차등록번호판의 영치 일시 해제를 취소하고, 자동차등록번호판을 다시 영치할 수 있다.

⑤ 특별시장ㆍ광역시장ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 제2항에 따라 자동차등록번호판의 영치 일시 해제 또는 일시 해제 기간의 연장을 하거나 제4항에 따라 자동차등록번호판을 다시 영치한 때에는 납세의무자에게 그 사실을 통지해야 한다.
