지방세법 시행령 제4조의2(건축물의 시가표준액 결정 절차 등)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장(구청장은 자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)은 제4조제1항제1호 및 제1호의2의 방식에 따라 관할 구역 내 건축물의 시가표준액을 산정한다.

(1) The^ð더 Mayor메이어 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 City,시티 the^ð더 Governor거^v버너 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 Province,프^r라^v븐스 or오 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 (the^ð더 head헤드 of어^v브 a어 Gu구 means민즈 the^ð더 head헤드 of어^v브 an앤 autonomous오타너머스 Gu;구 hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "head헤드 of어^v브 a어 Si/Gun/Gu")시 shall섈 calculate캘큘레잇 the^ð더 standard스탠더드 market마킷 value^v밸류 of어^v브 buildings빌딩즈 within위^ð딘 his히즈 or오 her허 jurisdiction주^r러스딕션 according어코딩 to투 the^ð더 methods메^θ써즈 in인 Article아터클 4 (1) 1 and앤드 1-2.

② 시장ㆍ군수ㆍ구청장은 제1항에 따라 산정한 건축물의 시가표준액에 대하여 행정안전부령으로 정하는 절차에 따라 10일 이상 건축물의 소유자와 이해관계인(이하 이 조에서 "소유자등"이라 한다)의 의견을 들어야 한다. <개정 2023.12.29>

③ 시장ㆍ군수ㆍ구청장은 다음 각 호의 어느 하나에 해당하는 경우에는 제1항에 따라 산정한 시가표준액을 행정안전부장관이 정하는 기준에 따라 변경할 수 있다. 이 경우 시장ㆍ군수ㆍ구청장(특별자치시장 및 특별자치도지사는 제외한다)은 그 변경 전에 특별시장ㆍ광역시장 또는 도지사(이하 이 조 및 제4조의3에서 "시ㆍ도지사"라 한다)의 승인을 받아야 한다. <개정 2023.6.30>

④ 시장ㆍ군수ㆍ구청장은 제3항에도 불구하고 이미 산정된 시가표준액의 100분의 20을 초과하여 시가표준액을 변경하려는 경우에는 다음 각 호의 구분에 따른 절차를 거쳐야 한다.

⑤ 시장ㆍ군수ㆍ구청장은 제1항, 제3항 및 제4항에 따라 산정(변경산정을 포함한다)한 시가표준액을 결정하여 매년 6월 1일까지 고시해야 한다. 이 경우 시장ㆍ군수ㆍ구청장(특별자치시장 및 특별자치도지사는 제외한다)은 그 결정 전에 시ㆍ도지사의 승인을 받아야 한다.

⑥ 시장ㆍ군수ㆍ구청장(특별자치시장 및 특별자치도지사는 제외한다)은 제5항에 따라 결정한 시가표준액을 시ㆍ도지사에게 제출해야 한다.

(6) The^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 (excluding익스클루딩 the^ð더 Mayor메이어 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 City시티 and앤드 the^ð더 Governor거^v버너 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 Province)프^r라^v븐스 shall섈 submit서브밋 the^ð더 standard스탠더드 market마킷 value^v밸류 determined디터먼드 under언더 paragraph패^r러그^r래^f프 (5) to투 the^ð더 Mayor/Do메이어 Governor.거^v버너

⑦ 특별자치시장, 특별자치도지사나 시ㆍ도지사는 제5항에 따라 결정한 시가표준액이나 제6항에 따라 제출받은 시가표준액을 관할 지방법원장에게 통보해야 한다.

(7) The^ð더 Mayor메이어 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 City,시티 the^ð더 Governor거^v버너 of어^v브 a어 Special스페실 Self-Governing셀^f프-거^v버닝 Province,프^r라^v븐스 or오 the^ð더 Mayor/Do메이어 Governor거^v버너 shall섈 notify노우터^f파이 the^ð더 chief치^f프 judge저지 of어^v브 the^ð더 district디스트^r릭트 court코트 having해^v빙 jurisdiction주^r러스딕션 of어^v브 the^ð더 standard스탠더드 market마킷 value^v밸류 determined디터먼드 under언더 paragraph패^r러그^r래^f프 (5) or오 submitted서브미티드 under언더 paragraph패^r러그^r래^f프 (6).
