지방세법 제131조(자동차등록번호판의 영치 등)

① 시장ㆍ군수ㆍ구청장은 자동차세의 납부의무를 이행하지 아니한 자가 있을 때에는 특별시장ㆍ광역시장ㆍ도지사에게 대통령령으로 정하는 바에 따라 그 자동차등록증을 발급하지 아니하거나 해당 자동차의 등록번호판의 영치(領置)를 요청하여야 한다. 다만, 특별자치시ㆍ특별자치도의 경우와 자동차등록업무가 시장ㆍ군수ㆍ구청장에게 위임되어 있는 경우에는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장은 그 자동차등록증을 발급하지 아니하거나 해당 자동차의 등록번호판을 영치할 수 있다. <개정 2016.12.27, 2017.12.26>

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장은 제1항에 따라 자동차등록번호판이 영치된 납세의무자가 해당 자동차를 직접적인 생계유지 목적으로 사용하고 있어 자동차등록번호판을 영치하게 되면 납세의무자의 생계유지가 곤란할 것으로 인정되는 경우 자동차등록번호판을 내주고 영치를 일시 해제하거나 특별시장ㆍ광역시장 또는 도지사에게 이를 요청할 수 있다. <신설 2018.12.31>
