지방세특례제한법 시행령 제48조의4(의료비 세액공제)

① 법 제97조의4제2항 각 호 외의 부분에서 "대통령령으로 정하는 의료비"란 「소득세법 시행령」 제118조의5제1항 각 호의 어느 하나에 해당하는 의료비를 말한다.

② 제1항에 따른 의료비에는 「소득세법 시행령」 제118조의5제2항에 따른 비용은 포함하지 아니한다.

③ 특별징수의무자는 「지방세법」 제103조의15에 따른 근로소득세액 연말정산을 할 때 특별세액공제 대상이 되는 의료비가 있는 근로자에 대해서는 「소득세법 시행령」 제215조제2항에 따른 근로소득지급명세서를 제출할 때에 해당 근로자의 의료비지급명세서가 전산처리된 테이프 또는 디스켓을 납세지 관할 지방자치단체의 장에게 제출하여야 한다. 다만, 「소득세법 시행령」 제118조의5제3항에 따라 납세지 관할 세무서장에게 해당 근로자의 의료비지급명세서가 전산처리된 테이프 또는 디스켓을 제출한 경우에는 납세지 관할 지방자치단체의 장에게도 함께 제출한 것으로 본다.
