지방자치법 시행령 제49조(제척과 회피)

① 지방의회의원은 직접 이해관계가 있거나 공정한 감사 또는 조사를 수행하기 현저히 어려운 사정이 있는 경우에는 해당 감사 또는 조사에 참여할 수 없다.

② 본회의나 감사ㆍ조사위원회는 지방의회의원에게 제1항에 해당하는 사정이 있다고 인정하는 경우에는 본회의나 감사ㆍ조사위원회의 의결로 해당 의원의 감사 또는 조사를 중지시키고 다른 지방의회의원으로 하여금 감사하거나 조사하게 해야 한다.

③ 제2항의 조치에 대하여 해당 지방의회의원의 이의가 있는 경우에는 본회의에서 의결하는 바에 따른다.

(3) Where웨어 the^ð더 local로우클 council카운슬 member멤버 concerned컨선드 objects아브젝츠 to투 the^ð더 measure메저 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 matter매터 shall섈 be비 decided디사이디드 by바이 resolution^r레절루션 of어^v브 the^ð더 plenary플레너^r리 session.세션

④ 제1항의 사유가 있는 지방의회의원은 그 사안에 한정하여 본회의나 감사ㆍ조사위원회의 허가를 받아 감사 또는 조사를 회피할 수 있다.
