지방자치법 제76조(의안의 발의)

① 지방의회에서 의결할 의안은 지방자치단체의 장이나 조례로 정하는 수 이상의 지방의회의원의 찬성으로 발의한다.

② 위원회는 그 직무에 속하는 사항에 관하여 의안을 제출할 수 있다.

③ 제1항 및 제2항의 의안은 그 안을 갖추어 지방의회의 의장에게 제출하여야 한다.

④ 제1항에 따라 지방의회의원이 조례안을 발의하는 경우에는 발의 의원과 찬성 의원을 구분하되, 해당 조례안의 제명의 부제로 발의 의원의 성명을 기재하여야 한다. 다만, 발의 의원이 2명 이상인 경우에는 대표발의 의원 1명을 명시하여야 한다.

⑤ 지방의회의원이 발의한 제정조례안 또는 전부개정조례안 중 지방의회에서 의결된 조례안을 공표하거나 홍보하는 경우에는 해당 조례안의 부제를 함께 표기할 수 있다.
