채무자 회생 및 파산에 관한 법률 제338조(거래소의 시세있는 상품의 정기매매)

①거래소의 시세있는 상품의 매매에 관하여 일정한 일시 또는 일정한 기간 안에 이행을 하지 아니하면 계약의 목적을 달성하지 못하는 경우 그 시기가 파산선고 후에 도래하는 때에는 계약의 해제가 있은 것으로 본다. 이 경우 손해배상액은 이행지에서 동종의 거래가 동일한 시기에 이행되는 때의 시세와 매매대가와의 차액에 의하여 정한다.

②제337조제1항의 규정은 제1항의 규정에 의한 손해배상에 관하여 준용한다.
