초ㆍ중등교육법 시행령 제59조(위원의 선출 등)

①국ㆍ공립학교의 장은 운영위원회의 당연직 교원위원이 된다.

② 학부모위원은 민주적 대의절차에 따라 학부모 전체회의를 통하여 학부모 중에서 투표로 선출한다. 이 경우 학부모 전체회의에 직접 참석할 수 없는 학부모는 학부모 전체회의 개최 전까지 가정통신문에 대한 회신, 우편투표, 전자적 방법(「전자문서 및 전자거래 기본법」 제2조제2호에 따른 정보처리시스템을 사용하거나 그 밖에 정보통신기술을 이용하는 방법을 말한다)에 의한 투표 등 위원회규정으로 정하는 방법 및 절차에 따라 후보자에게 투표할 수 있다. <개정 2015.9.15, 2020.2.25>

③ 제2항에도 불구하고 학교의 규모ㆍ시설 등을 고려하여 학부모 전체회의를 통하여 학부모위원을 선출하기 곤란하다고 위원회규정으로 정한 사유에 해당하는 경우에는 위원회규정으로 정하는 바에 따라 학급별 대표로 구성된 학부모대표회의에서 학부모위원을 선출할 수 있다. <신설 2015.9.15>

④당연직 교원위원을 제외한 교원위원은 교원 중에서 선출하되, 교직원 전체회의에서 무기명투표로 선출한다. <개정 2000.2.28, 2015.9.15, 2020.4.7>

⑤ 제2항부터 제4항까지의 규정에도 불구하고 「재난 및 안전관리 기본법」 제3조제1호에 따른 재난이나 그 밖의 불가피한 사유로 학부모 전체회의, 학부모대표회의 또는 교직원 전체회의를 개최하기 어려운 경우에는 제2항 후단에 따른 방법 및 절차에 따라 학부모위원 또는 당연직 교원위원을 제외한 교원위원을 선출할 수 있다. <신설 2020.4.7>

⑧ 국ㆍ공립학교에 두는 운영위원회 위원이 그 지위를 남용하여 해당 학교와의 거래 등을 통하여 재산상의 권리ㆍ이익을 취득하거나 다른 사람을 위하여 그 취득을 알선한 경우에는 운영위원회의 의결로 그 자격을 상실하게 할 수 있다. <신설 2011.3.18, 2015.9.15, 2020.4.7>
