초ㆍ중등교육법 시행령 제98조의2(학력심의위원회의 설치ㆍ운영 등)

① 다음 각 호의 어느 하나에 해당하는 사람의 학력인정에 관한 사항을 심의하기 위하여 교육감 소속으로 학력심의위원회를 둔다. <개정 2013.10.30, 2017.11.28, 2020.7.14>

② 학력심의위원회는 위원장 1명을 포함하여 5명 이상 30명 이내의 위원으로 구성한다. <개정 2020.7.14>

③ 학력심의위원회의 위원은 제1항 각 호의 어느 하나에 해당하는 사람(이하 "북한이탈주민등"이라 한다)에 관한 업무를 담당하는 공무원, 교육전문가 및 학력 평가전문가 중에서 교육감이 임명하거나 위촉하고, 위원장은 위원 중에서 호선(互選)한다. <개정 2013.10.30, 2017.11.28>

④ 학력심의위원회의 위원의 임기는 2년으로, 위원장의 임기는 1년으로 하고, 각각 연임할 수 있다.

⑤ 학력심의위원회는 다음 각 호의 사항을 심의한다. <개정 2013.10.30>

⑥ 학력심의위원회는 심의에 필요한 경우 북한이탈주민등에 대하여 전문기관을 통한 학습능력 평가 등 학력인정 및 학년결정을 위한 평가를 실시할 수 있다. <신설 2017.11.28>

⑦ 이 영에서 규정한 사항 외에 학력심의위원회의 구성ㆍ운영, 학력인정을 위한 평가의 기준ㆍ대상ㆍ방법ㆍ시기 등 필요한 사항은 교육감이 정한다. <개정 2017.11.28>

⑧ 제1항부터 제7항까지의 규정에도 불구하고 학력심의위원회와 성격ㆍ기능이 유사한 위원회가 해당 교육감 소속으로 설치되어 있는 경우에는 해당 시ㆍ도의 조례로 정하는 바에 따라 그 위원회가 학력심의위원회의 기능을 대신할 수 있다. 다만, 성격ㆍ기능이 유사한 위원회의 설치 근거가 되는 법령 또는 조례에서 위원회의 구성ㆍ운영 관련 사항을 교육감이 정하도록 하고 있거나 교육규칙으로 정하도록 하고 있는 경우에는 해당 시ㆍ도의 교육규칙으로 정하는 바에 따라 대신할 수 있다. <신설 2017.12.29>
