Act on the Aggravated Punishment, etc. of Specific Crimes, Article 5-12 (Aggravated Punishment of Masters or Crew Members of Fleeing Vessels)

「해사안전기본법」 제3조제2호에 따른 선박의 교통으로 인하여 「형법」 제268조의 죄를 범한 해당 선박의 선장 또는 승무원이 피해자를 구호하는 등 「수상에서의 수색ㆍ구조 등에 관한 법률」 제18조제1항 단서에 따른 조치를 하지 아니하고 도주한 경우에는 다음 각 호의 구분에 따라 가중 처벌한다. <개정 2015.7.24, 2023.7.25>

1. 피해자를 사망에 이르게 하고 도주하거나, 도주 후에 피해자가 사망한 경우에는 무기 또는 5년 이상의 징역에 처한다.
