특허법 제28조(서류제출의 효력발생시기)

① 이 법 또는 이 법에 따른 명령에 따라 지식재산처장 또는 특허심판원장에게 제출하는 출원서, 청구서, 그 밖의 서류(물건을 포함한다. 이하 이 조에서 같다)는 지식재산처장 또는 특허심판원장에게 도달한 날부터 제출의 효력이 발생한다. <개정 2014.6.11, 2025.10.1>

② 제1항의 출원서, 청구서, 그 밖의 서류를 우편으로 지식재산처장 또는 특허심판원장에게 제출하는 경우에는 다음 각 호의 구분에 따른 날에 지식재산처장 또는 특허심판원장에게 도달한 것으로 본다. 다만, 특허권 및 특허에 관한 권리의 등록신청서류와 「특허협력조약」 제2조(vii)에 따른 국제출원(이하 "국제출원"이라 한다)에 관한 서류를 우편으로 제출하는 경우에는 그 서류가 지식재산처장 또는 특허심판원장에게 도달한 날부터 효력이 발생한다. <개정 2014.6.11, 2025.10.1>
