할부거래에 관한 법률 제39조의2(관계 기관의 협조)

① 공정거래위원회는 지급의무자가 이 법을 위반한 혐의가 있다고 인정되는 때에는 금융위원회 등 해당 지급의무자를 감독하는 중앙행정기관의 장에게 해당 지급의무자에 대한 조사, 제재 등 그 시정을 위하여 필요한 조치를 요청할 수 있다.

② 공정거래위원회는 선불식 할부거래업자의 제34조의2에 따른 의무위반행위로 인하여 제35조제1항에 따른 의무위반행위의 조사를 하는 경우 금융위원회에 지원을 요청할 수 있다. <신설 2026.9.8>

③ 금융위원회는 제2항에 따른 요청을 받은 경우 「금융위원회의 설치 등에 관한 법률」 제24조에 따른 금융감독원의 원장으로 하여금 공정거래위원회와 제35조제1항에 따른 의무위반행위의 조사를 하게 할 수 있다. 이 경우 제35조제6항을 준용하되, "한국소비자원"은 "금융감독원"으로 본다. <신설 2026.9.8>
