1. 급박한 위해의 방지 및 제거 등 공공의 안전 또는 복리를 위하여 긴급한 처분이 필요한 경우

3. 의견청취의 기회를 줌으로써 처분의 내용이 미리 알려져 현저히 공익을 해치는 행위를 유발할 우려가 예상되는 등 해당 처분의 성질상 의견청취가 현저하게 곤란한 경우

5. 법령등에서 일정한 요건에 해당하는 자에 대하여 점용료ㆍ사용료 등 금전급부를 명하는 경우 법령등에서 규정하는 요건에 해당함이 명백하고, 행정청의 금액산정에 재량의 여지가 없거나 요율이 명확하게 정하여져 있는 경우 등 해당 처분의 성질상 의견청취가 명백히 불필요하다고 인정될 만한 상당한 이유가 있는 경우
