형사보상 및 명예회복에 관한 법률 제19조(보상청구의 중단과 승계)

① 보상을 청구한 자가 청구절차 중 사망하거나 상속인 자격을 상실한 경우에 다른 청구인이 없을 때에는 청구의 절차는 중단된다.

② 제1항의 경우에 보상을 청구한 자의 상속인 또는 보상을 청구한 상속인과 같은 순위의 상속인은 2개월 이내에 청구의 절차를 승계할 수 있다.

(2) In인 the^ð더 case케이스 of어^v브 paragraph패^r러그^r래^f프 (1), an앤 heir에어 of어^v브 the^ð더 person퍼슨 who후 claimed클레임드 compensation,캄펀세이션 or오 an앤 heir에어 of어^v브 the^ð더 same세임 rank^r랭크 as애즈 the^ð디 heir에어 who후 claimed클레임드 compensation,캄펀세이션 may메이 take테이크 over오우^v버 the^ð더 claim클레임 proceedings프^r로시딩즈 within위^ð딘 two투 months.먼^θ쓰

③ 법원은 제2항에 따라 절차를 승계할 수 있는 자로서 법원에 알려진 자에게는 지체 없이 제2항의 기간 내에 청구의 절차를 승계할 것을 통지하여야 한다.

④ 제2항의 기간 내에 절차를 승계하는 신청이 없을 때에는 법원은 청구를 각하하는 결정을 하여야 한다.
