형의 집행 및 수용자의 처우에 관한 법률 제117조의2(정보공개청구)

① 수용자는 「공공기관의 정보공개에 관한 법률」에 따라 법무부장관, 지방교정청장 또는 소장에게 정보의 공개를 청구할 수 있다.

② 현재의 수용기간 동안 법무부장관, 지방교정청장 또는 소장에게 제1항에 따른 정보공개청구를 한 후 정당한 사유 없이 그 청구를 취하하거나 「공공기관의 정보공개에 관한 법률」 제17조에 따른 비용을 납부하지 아니한 사실이 2회 이상 있는 수용자가 제1항에 따른 정보공개청구를 한 경우에 법무부장관, 지방교정청장 또는 소장은 그 수용자에게 정보의 공개 및 우송 등에 들 것으로 예상되는 비용을 미리 납부하게 할 수 있다.

③ 제2항에 따라 정보의 공개 및 우송 등에 들 것으로 예상되는 비용을 미리 납부하여야 하는 수용자가 비용을 납부하지 아니한 경우 법무부장관, 지방교정청장 또는 소장은 그 비용을 납부할 때까지 「공공기관의 정보공개에 관한 법률」 제11조에 따른 정보공개 여부의 결정을 유예할 수 있다.

④ 제2항에 따른 예상비용의 산정방법, 납부방법, 납부기간, 그 밖에 비용납부에 관하여 필요한 사항은 대통령령으로 정한다.
