형의 집행 및 수용자의 처우에 관한 법률 제2조(정의)

1. "수용자"란 수형자ㆍ미결수용자ㆍ사형확정자 등 법률과 적법한 절차에 따라 교도소ㆍ구치소 및 그 지소(이하 "교정시설"이라 한다)에 수용된 사람을 말한다.

2. "수형자"란 징역형ㆍ금고형 또는 구류형의 선고를 받아 그 형이 확정되어 교정시설에 수용된 사람과 벌금 또는 과료를 완납하지 아니하여 노역장 유치명령을 받아 교정시설에 수용된 사람을 말한다.

3. "미결수용자"란 형사피의자 또는 형사피고인으로서 체포되거나 구속영장의 집행을 받아 교정시설에 수용된 사람을 말한다.
