형의 집행 및 수용자의 처우에 관한 법률 제28조(유류금품의 처리)

① 소장은 사망자 또는 도주자가 남겨두고 간 금품이 있으면 사망자의 경우에는 그 상속인에게, 도주자의 경우에는 그 가족에게 그 내용 및 청구절차 등을 알려 주어야 한다. 다만, 썩거나 없어질 우려가 있는 것은 폐기할 수 있다. <개정 2020.2.4>

② 소장은 상속인 또는 가족이 제1항의 금품을 내어달라고 청구하면 지체 없이 내어주어야 한다. 다만, 제1항에 따른 알림을 받은 날(알려줄 수가 없는 경우에는 청구사유가 발생한 날)부터 1년이 지나도 청구하지 아니하면 그 금품은 국고에 귀속된다. <개정 2020.2.4>
