건설산업기본법 제87조(건설근로자 퇴직공제제도의 시행)

① 대통령령으로 정하는 건설공사를 하는 건설사업자는 「건설근로자의 고용개선 등에 관한 법률」에 따른 건설근로자 퇴직공제제도에 가입하여야 한다. <개정 2019.4.30>

② 제1항에 따라 건설근로자 퇴직공제제도에 가입하여야 하는 건설공사 도급계약의 당사자는 대통령령으로 정하는 바에 따라 그 건설공사의 도급금액 산출명세서에 건설근로자 퇴직공제제도의 가입에 드는 금액을 분명하게 적어야 한다.

③ 국토교통부장관은 제23조에 따른 시공능력의 평가나 그 밖의 건설시책을 시행할 때 제2항에 따라 건설근로자 퇴직공제제도에 가입한 건설사업자를 우대할 수 있다. <개정 2013.3.23, 2019.4.30>
