게임산업진흥에 관한 법률 제29조(영업의 승계)

①제25조 또는 제26조에 따라 허가를 받은 영업자 또는 등록ㆍ신고를 한 영업자가 그 영업을 양도하거나 사망한 때 또는 그 법인의 합병이 있는 때에는 그 양수인ㆍ상속인 또는 합병 후 존속하는 법인이나 합병에 의하여 설립되는 법인은 그 영업자의 지위를 승계한다. <개정 2007.1.19, 2023.8.8>

②제30조에 따른 폐업신고에 의하여 허가가 취소되거나 등록 또는 신고가 말소된 자가 1년 이내에 폐업한 장소에서 같은 업종으로 다시 허가를 받거나 등록 또는 신고를 하고자 하는 경우에는 해당 영업자는 폐업신고 전의 영업자의 지위를 승계한다. <개정 2007.1.19, 2016.12.20, 2023.8.8>

③「민사집행법」에 의한 경매, 「채무자 회생 및 파산에 관한 법률」에 의한 환가나 「국세징수법」ㆍ「관세법」 또는 「지방세징수법」에 의한 압류재산의 매각 그 밖에 이에 준하는 절차에 따라 영업자의 시설ㆍ기구(대통령령으로 정하는 주요시설 및 기구를 말한다)의 전부를 인수한 자는 그 영업자의 지위를 승계한다. <개정 2010.3.31, 2016.12.27, 2023.8.8>

④제1항부터 제3항까지에 따라 영업자의 지위를 승계받은 자는 관할 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2007.1.19, 2018.2.21, 2023.8.8>

⑤ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제4항에 따른 신고를 받은 날부터 15일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.12.11>

⑥ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제5항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.12.11>
