공공기관의 정보공개에 관한 법률 제2조(정의)
Official Information Disclosure Act, Article 2 (Definitions)
이 법에서 사용하는 용어의 뜻은 다음과 같다. <개정 2020.12.22>
The terms used in this Act have the following meanings:
1. "정보"란 공공기관이 직무상 작성 또는 취득하여 관리하고 있는 문서(전자문서를 포함한다. 이하 같다) 및 전자매체를 비롯한 모든 형태의 매체 등에 기록된 사항을 말한다.
1. "Information" means matters recorded in documents (including electronic documents; the same applies below) and in media of all forms, including electronic media, that a public institution has prepared or obtained in the course of its duties and is managing.
2. "공개"란 공공기관이 이 법에 따라 정보를 열람하게 하거나 그 사본ㆍ복제물을 제공하는 것 또는 「전자정부법」 제2조제10호에 따른 정보통신망(이하 "정보통신망"이라 한다)을 통하여 정보를 제공하는 것 등을 말한다.
2. "Disclosure" means that a public institution, under this Act, lets a person inspect information or provides copies or reproductions of it, or provides information through an information and communications network under Article 2, subparagraph 10 of the Electronic Government Act (hereinafter referred to as an "information and communications network"), and the like.
3. "공공기관"이란 다음 각 목의 기관을 말한다.
3. "Public institution" means any of the following institutions:
가. 국가기관
(a) State agencies:
1) 국회, 법원, 헌법재판소, 중앙선거관리위원회
1) The National Assembly, the courts, the Constitutional Court, and the National Election Commission;
2) 중앙행정기관(대통령 소속 기관과 국무총리 소속 기관을 포함한다) 및 그 소속 기관
2) Central administrative agencies (including agencies under the President and agencies under the Prime Minister) and the agencies under them;
3) 「행정기관 소속 위원회의 설치ㆍ운영에 관한 법률」에 따른 위원회
3) Committees under the Act on the Establishment and Operation of Committees under Administrative Agencies;
나. 지방자치단체
(b) Local governments;
다. 「공공기관의 운영에 관한 법률」 제2조에 따른 공공기관
(c) Public institutions under Article 2 of the Act on the Management of Public Institutions;
라. 「지방공기업법」에 따른 지방공사 및 지방공단
(d) Local public corporations and local public agencies under the Local Public Enterprises Act;
마. 그 밖에 대통령령으로 정하는 기관
(e) Other institutions prescribed by Presidential Decree.
