공익신고자 보호법 제28조(보상금 등의 중복 지급 금지 등)

① 이 법에 따라 보상금, 포상금 또는 구조금(이하 이 항 및 제29조에서 "보상금등"이라 한다)을 지급받을 사람은 다른 법령에 따라 보상금등을 청구할 수 있다.

② 위원회는 이 법에 따라 보상금 또는 포상금을 지급받을 사람이 동일한 원인으로 이 법에 따른 보상금ㆍ포상금을 받았거나 다른 법령에 따른 보상금ㆍ포상금 등을 받은 경우 그 보상금ㆍ포상금 등의 액수가 이 법에 따라 지급받을 보상금ㆍ포상금의 액수와 같거나 이를 초과할 때에는 보상금ㆍ포상금을 지급하지 아니하며, 그 보상금ㆍ포상금 등의 액수가 이 법에 따라 지급받을 보상금ㆍ포상금의 액수보다 적을 때에는 그 금액을 공제하고 보상금ㆍ포상금의 액수를 정하여야 한다.

③ 위원회는 이 법에 따라 구조금을 지급받을 사람이 동일한 원인으로 이 법에 따른 구조금을 받았거나 다른 법령에 따른 구조금을 받은 경우 그 구조금의 액수가 이 법에 따라 지급받을 구조금의 액수와 같거나 이를 초과할 때에는 구조금을 지급하지 아니하며, 그 구조금의 액수가 이 법에 따라 지급받을 구조금의 액수보다 적을 때에는 그 금액을 공제하고 구조금의 액수를 정하여야 한다.

④ 다른 법령에 따라 보상금ㆍ포상금 등을 지급할 기관은 보상금ㆍ포상금 등을 지급받을 사람이 동일한 원인으로 이 법에 따른 보상금ㆍ포상금을 받은 경우 그 보상금ㆍ포상금의 액수가 다른 법령에 따라 지급받을 보상금ㆍ포상금 등의 액수와 같거나 이를 초과할 때에는 다른 법령에 따른 보상금ㆍ포상금 등을 지급하지 아니하며, 그 보상금ㆍ포상금의 액수가 다른 법령에 따라 지급받을 보상금ㆍ포상금 등의 액수보다 적을 때에는 그 금액을 공제하고 보상금ㆍ포상금 등의 액수를 정하여야 한다.

⑤ 다른 법령에 따라 구조금을 지급할 기관은 구조금을 지급받을 사람이 동일한 원인으로 이 법에 따른 구조금을 받은 경우 그 구조금의 액수가 다른 법령에 따라 지급받을 구조금의 액수와 같거나 이를 초과할 때에는 다른 법령에 따른 구조금을 지급하지 아니하며, 그 구조금의 액수가 다른 법령에 따라 지급받을 구조금의 액수보다 적을 때에는 그 금액을 공제하고 구조금의 액수를 정하여야 한다.
