Public Official Election Act, Article 158 (Early Voting)

① 선거인(거소투표자와 선상투표자는 제외한다)은 누구든지 사전투표기간 중에 사전투표소에 가서 투표할 수 있다.

② 사전투표를 하려는 선거인은 사전투표소에서 신분증명서를 제시하여 본인임을 확인받은 다음 전자적 방식으로 손도장을 찍거나 서명한 후 투표용지를 받아야 한다. 이 경우 중앙선거관리위원회는 해당 선거인에게 투표용지가 교부된 사실을 확인할 수 있도록 신분증명서의 일부를 전자적 이미지 형태로 저장하여 선거일의 투표마감시각까지 보관하여야 한다. <개정 2015.8.13>

③ 사전투표관리관은 투표용지 발급기로 선거권이 있는 해당 선거의 투표용지를 인쇄하여 "사전투표관리관"칸에 자신의 도장을 찍은 후 일련번호를 떼지 아니하고 회송용 봉투와 함께 선거인에게 교부한다.

④ 투표용지와 회송용 봉투를 받은 선거인은 기표소에 들어가 투표용지에 1명의 후보자(비례대표국회의원선거 및 비례대표지방의회의원선거에서는 하나의 정당을 말한다)를 선택하여 투표용지의 해당 칸에 기표한 다음 그 자리에서 기표내용이 다른 사람에게 보이지 아니하게 접어 이를 회송용 봉투에 넣어 봉함한 후 사전투표함에 넣어야 한다.

⑤ 제3항 및 제4항에도 불구하고 사전투표관리관은 중앙선거관리위원회규칙으로 정하는 구역의 선거인에게는 회송용 봉투를 교부하지 아니할 수 있다.

⑥ 사전투표관리관은 사전투표기간 중 매일의 사전투표마감 후 또는 사전투표기간 종료 후 투표지를 인계하는 경우에는 사전투표참관인의 참관 하에 다음 각 호에 따라 처리한다. <개정 2014.2.13, 2021.3.26>

1. 제3항 및 제4항에 따라 투표용지와 회송용 봉투를 함께 교부하여 투표하게 한 경우에는 사전투표함을 개함하고 사전투표자수를 계산한 후 관할 우체국장에게 인계하여 등기우편으로 발송한다. 이 경우 사전투표관리관은 후보자별로 사전투표참관인 1명씩을 지정하여 해당 우체국까지 동행하여야 하며, 사전투표관리관이 지정한 사전투표참관인이 정당한 사유 없이 동행을 거부한 때에는 그 권한을 포기한 것으로 보고 투표록에 그 사유를 기재한다.

2. 제5항에 따라 회송용 봉투를 교부하지 아니하고 투표하게 한 경우에는 해당 사전투표함을 직접 관할 구ㆍ시ㆍ군선거관리위원회에 인계한다. 이 경우 사전투표함 등의 송부에 관하여는 제170조를 준용한다.

⑦ 투표용지를 교부하지 아니하는 경우와 투표소 출입 등에 관하여는 제157조제3항 및 제5항부터 제7항까지의 규정을 준용한다.
