공직선거법 제61조의2(정당선거사무소의 설치)

①정당은 선거에 있어서 당해 선거에 관한 정당의 사무를 처리하기 위하여 다음 각 호에서 정하는 날(그 날후에 실시사유가 확정된 보궐선거등에 있어서는 그 선거의 실시사유가 확정된 때)부터 선거일후 30일까지 선거구안에 있는 구ㆍ시ㆍ군(하나의 구ㆍ시ㆍ군이 2 이상의 국회의원지역구로 되거나 하나의 구ㆍ시ㆍ군의 일부가 인접한 구ㆍ시ㆍ군의 일부와 결합하여 국회의원지역구로 된 경우에는 국회의원지역구를 말한다)마다 1개소의 정당선거사무소를 설치할 수 있다. <개정 2005.8.4, 2026.3.19>

②정당선거사무소에는 당원중에서 소장 1인을 두어야 하며, 2인 이내의 유급사무직원을 둘 수 있다.

③중앙당 또는 시ㆍ도당의 대표자는 정당선거사무소를 설치하는 때에는 지체없이 관할선거관리위원회에 다음 각호의 사항을 서면으로 신고하여야 한다. 이 경우 신고사항의 변경이 있는 때에는 지체없이 그 변경사항을 신고하여야 한다. <개정 2005.8.4>

④정당선거사무소에는 중앙선거관리위원회규칙으로 정하는 바에 따라 정당의 홍보에 필요한 사항을 게재한 간판ㆍ현판ㆍ현수막을 설치ㆍ게시할 수 있다. <개정 2010.1.25>

⑤정당선거사무소의 소장은 이 법 또는 다른 법률의 규정에 의한 신고ㆍ신청ㆍ제출ㆍ보고ㆍ추천 등에 관하여 당해 정당을 대표한다.

⑥정당은 선거일후 30일이 지난 때에는 제1항의 규정에 의한 정당선거사무소를 즉시 폐쇄하여야 한다.

⑦제61조(선거운동기구의 설치)제2항 및 제5항의 규정은 정당선거사무소에 이를 준용한다. 이 경우 "선거사무소 또는 선거연락소"와 "선거사무소와 선거연락소"는 "정당선거사무소"로 본다.
