국가공무원법 제41조(승진시험 방법)

① 승진시험은 일반 승진시험과 공개경쟁 승진시험으로 구분한다.

② 일반 승진시험은 승진후보자 명부의 높은 순위에 있는 자부터 차례로 임용하려는 결원 또는 결원과 예상 결원을 합한 총결원의 2배수 이상 5배수 이내 범위의 자에 대하여 실시하며, 시험성적 점수와 승진후보자 명부에 따른 평정 점수를 합산한 종합 성적에 따라 합격자를 결정한다. 다만, 유능한 공무원을 발탁하기 위하여 승진기회의 확대가 필요한 경우에는 대통령령으로 정하는 바에 따라 배수의 범위를 달리하여 시험을 실시할 수 있다. <개정 2011.5.23>

③ 공개경쟁 승진시험은 5급 공무원 승진에 한정하되, 기관간 승진기회의 균형을 유지하고 유능한 공무원을 발탁하기 위하여 필요한 경우에 실시하며, 시험성적에 따라 합격자를 결정한다.

④ 제2항과 제3항에 따른 승진시험의 응시 대상자, 응시 방법, 합격자 결정 방법, 합격의 효력, 그 밖에 승진시험에 필요한 사항은 대통령령등으로 정한다. <개정 2015.5.18>
