국민투표법 제45조(개표참관인의 선정)

① 제15조에 따른 국민투표일공고일 현재 「정치자금법」 제27조에 따른 보조금 배분대상 정당(이하 이 조에서 "정당"이라 한다)은 개표소별로 6명의 개표참관인을 선정하여 국민투표일 전 2일까지 구ㆍ시ㆍ군선거관리위원회에 서면으로 신고하여야 한다.

② 제1항에 따른 개표참관인의 신고가 없거나, 하나의 정당이 선정ㆍ신고한 개표참관인밖에 없는 때에는 구ㆍ시ㆍ군선거관리위원회가 투표권자 중에서 본인의 승낙을 얻어 12명이 될 때까지 선정한 사람을 개표참관인으로 한다.
