국토의 계획 및 이용에 관한 법률 제43조(도시ㆍ군계획시설의 설치ㆍ관리)

① 지상ㆍ수상ㆍ공중ㆍ수중 또는 지하에 기반시설을 설치하려면 그 시설의 종류ㆍ명칭ㆍ위치ㆍ규모 등을 미리 도시ㆍ군관리계획으로 결정하여야 한다. 다만, 용도지역ㆍ기반시설의 특성 등을 고려하여 대통령령으로 정하는 경우에는 그러하지 아니하다. <개정 2011.4.14>

② 효율적인 토지이용을 위하여 둘 이상의 도시ㆍ군계획시설을 같은 토지에 함께 결정하거나 도시ㆍ군계획시설이 위치하는 공간의 일부를 구획하여 도시ㆍ군계획시설을 결정할 수 있다. <신설 2024.2.6>

③ 도시ㆍ군계획시설의 결정ㆍ구조 및 설치의 기준 등에 필요한 사항은 국토교통부령으로 정하고, 그 세부사항은 국토교통부령으로 정하는 범위에서 시ㆍ도의 조례로 정할 수 있다. 다만, 이 법 또는 다른 법률에 특별한 규정이 있는 경우에는 그에 따른다. <개정 2011.4.14, 2013.3.23, 2024.2.6>

④ 제1항에 따라 설치한 도시ㆍ군계획시설의 관리에 관하여 이 법 또는 다른 법률에 특별한 규정이 있는 경우 외에는 국가가 관리하는 경우에는 대통령령으로, 지방자치단체가 관리하는 경우에는 그 지방자치단체의 조례로 도시ㆍ군계획시설의 관리에 관한 사항을 정한다. <개정 2011.4.14, 2024.2.6>
