근로기준법 제96조(단체협약의 준수)

① 취업규칙은 법령이나 해당 사업 또는 사업장에 대하여 적용되는 단체협약과 어긋나서는 아니 된다.

② 고용노동부장관은 법령이나 단체협약에 어긋나는 취업규칙의 변경을 명할 수 있다. <개정 2010.6.4>
