기초연금법 제25조(비용의 분담)

① 국가는 지방자치단체의 노인인구 비율 및 재정 여건 등을 고려하여 기초연금의 지급에 드는 비용 중 100분의 40 이상 100분의 90 이하의 범위에서 대통령령으로 정하는 비율에 해당하는 비용을 부담한다.

② 제1항에 따라 국가가 부담하는 비용을 뺀 비용은 특별시ㆍ광역시ㆍ특별자치시ㆍ도ㆍ특별자치도(이하 "시ㆍ도"라 한다)와 시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)가 상호 분담한다. 이 경우, 그 부담비율은 노인인구 비율 및 재정여건 등을 고려하여 보건복지부장관과 협의하여 시ㆍ도의 조례 및 시ㆍ군ㆍ구의 조례로 정한다.
