기초연금법 시행령 제17조(미지급 기초연금의 청구 절차 및 방법 등)

① 법 제15조제1항에 따라 미지급 기초연금을 지급받으려는 사람은 보건복지부령으로 정하는 미지급 기초연금 지급 청구서에 다음 각 호의 서류를 첨부하여 사망한 기초연금 수급자의 주소지를 관할하는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

② 특별자치시장ㆍ특별자치도시자ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따라 미지급 기초연금의 지급 청구를 받으면 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 가족관계등록부를 확인하여야 한다. 다만, 미지급 기초연금을 받으려는 사람이 확인에 동의하지 아니하는 경우에는 그 서류를 첨부하도록 하여야 한다.

③ 제1항에 따라 미지급 기초연금의 지급 청구를 받은 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 미지급 기초연금 지급 청구서를 접수한 날부터 7일 이내에 보건복지부령으로 정하는 바에 따라 미지급 기초연금의 지급 여부를 청구인에게 통지하여야 한다.

④ 법 제15조제1항에 따라 미지급 기초연금의 지급을 청구할 수 있는 부양의무자(배우자와 직계혈족 및 그 배우자를 말한다. 이하 같다)는 다음 각 호의 어느 하나에 해당하는 사람으로 한다.

⑤ 법 제15조제1항에 따른 미지급 기초연금의 지급을 청구할 수 있는 부양의무자의 지급 청구순위는 다음 각 호의 순서로 한다.

⑥ 제5항에 따라 미지급 기초연금의 지급을 청구할 수 있는 순위가 같은 사람이 2명 이상이 있는 경우에는 그 순위가 같은 사람이 똑같이 나눈 금액의 지급을 각각 청구하여야 한다. 이 경우 같은 순위자 중 1명이 한 청구는 그 청구한 사람이 지급받을 부분에 대하여 청구한 것으로 본다. <개정 2019.7.2>

⑦ 제6항에도 불구하고 같은 순위자나 그의 법정대리인이 같은 순위자 전부 또는 일부의 기초연금 급여를 지급받을 대표자를 선정하면 그 대표자가 같은 순위자 전부 또는 일부에 해당하는 미지급 기초연금을 청구할 수 있다.
