기초연금법 시행령 제18조(기초연금 지급정지 대상)

① 법 제16조제1항제2호에 따라 기초연금 수급자가 행방불명, 실종 또는 가출 등으로 경찰서 등 관계 행정기관에 신고가 접수된 날부터 보건복지부장관이 정하는 기간까지 생사를 확인할 수 없는 경우에는 그 기간이 만료한 때에 사망한 것으로 추정한다.

② 법 제16조제1항제4호에서 "대통령령으로 정하는 경우"란 기초연금 수급자가 「주민등록법」 제20조제6항에 따라 거주불명자로 등록된 경우를 말한다. 다만, 기초연금 수급자의 실제 거주지를 알 수 있는 경우에는 그러하지 아니하다.
