농지법 제54조의4(토지등에의 출입)

① 농림축산식품부장관, 시장ㆍ군수ㆍ자치구구청장 또는 시ㆍ구ㆍ읍ㆍ면의 장은 다음 각 호의 조사를 위하여 필요한 경우에는 소속 공무원(제51조제2항에 따라 농림축산식품부장관이 다음 각 호의 업무를 한국농어촌공사, 농업 관련 기관 또는 농업 관련 단체에 위탁한 경우에는 그 기관 등의 임직원을 포함한다)으로 하여금 다른 사람의 토지 또는 건물 등(이하 이 조에서 "토지등"이라 한다)에 출입하게 할 수 있다.

② 제1항에 따라 다른 사람의 토지등에 출입하려는 사람은 해당 토지등의 소유자ㆍ점유자 또는 관리인(이하 이 조에서 "이해관계인"이라 한다)에게 그 일시와 장소를 우편, 전화, 전자메일 또는 문자전송 등을 통하여 통지하여야 한다. 다만, 이해관계인을 알 수 없는 때에는 그러하지 아니하다.

③ 해 뜨기 전이나 해가 진 후에는 이해관계인의 승낙 없이 택지나 담장 또는 울타리로 둘러싸인 해당 토지등에 출입할 수 없다.

④ 이해관계인은 정당한 사유 없이 제1항에 따른 출입을 거부하거나 방해하지 못한다.

⑤ 제1항에 따라 다른 사람의 토지등에 출입하려는 사람은 권한을 표시하는 증표를 지니고 이를 이해관계인에게 내보여야 한다.

⑥ 제5항에 따른 증표에 관하여 필요한 사항은 농림축산식품부령으로 정한다.
