도로법 제106조(권리ㆍ의무의 승계 등)

① 이 법에 따른 허가 또는 승인을 받은 자의 사망, 그 지위의 양도, 합병이나 분할 등의 사유가 있으면 이 법에 따른 허가 또는 승인으로 인하여 발생한 권리ㆍ의무는 다음 각 호의 구분에 따른 자가 승계한다.

(1) Where웨어 a어 person퍼슨 who후 has해즈 obtained어브테인드 permission퍼미션 or오 approval어프^r루^v블 under언더 this^ð디스 Act액트 dies,다이즈 transfers트^r랜스^f퍼즈 his히즈 or오 her허 status,스태터스 or오 undergoes언더고우즈 a어 merger머저 or오 division,디^v비전 etc.,엣세터^r러 the^ð더 rights^r라잇츠 and앤드 obligations아블러게이션즈 arising어^r라이징 from^f프^r럼 the^ð더 permission퍼미션 or오 approval어프^r루^v블 under언더 this^ð디스 Act액트 shall섈 be비 succeeded석시디드 to투 by바이 the^ð더 following^f팔로잉 persons:퍼슨즈

② 제1항에 따라 권리나 의무를 승계한 자는 2개월 내에 국토교통부령으로 정하는 바에 따라 도로관리청에 신고하여야 한다. <개정 2022.6.10>

(2) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 rights^r라잇츠 or오 obligations아블러게이션즈 under언더 paragraph패^r러그^r래^f프 (1) shall섈 report^r리포트 it잇 to투 the^ð더 road^r로우드 management매너지먼트 authority어^θ쏘^r러티 within위^ð딘 two투 months,먼^θ쓰 as애즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport.트^r랜스포트

③ 도로관리청은 제2항에 따른 신고를 받은 날부터 15일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.12.18>

(3) The^ð더 road^r로우드 management매너지먼트 authority어^θ쏘^r러티 shall섈 notify노우터^f파이 the^ð더 reporting^r리포팅 person퍼슨 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 within위^ð딘 15 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (2).

④ 도로관리청이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.12.18>

(4) If이^f프 the^ð더 road^r로우드 management매너지먼트 authority어^θ쏘^r러티 fails^f페일즈 to투 notify노우터^f파이 the^ð더 reporting^r리포팅 person,퍼슨 within위^ð딘 the^ð더 period피^r리어드 specified스페서^f파이드 in인 paragraph패^r러그^r래^f프 (3), of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 the^ð더 report^r리포트 shall섈 be비 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 after애^f프터 that^ð댓 period피^r리어드 ends엔즈 (or,오 where웨어 the^ð더 processing프^r라세싱 period피^r리어드 has해즈 been빈 extended익스텐디드 or오 further^f퍼^ð더 extended익스텐디드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 after애^f프터 that^ð댓 processing프^r라세싱 period피^r리어드 ends).엔즈

⑤ 도로점용허가를 받은 자가 점용의 목적이 되는 토지나 건물의 소유권을 타인에게 양도하는 경우에는 해당 도로점용허가에 따른 권리ㆍ의무도 함께 양도한 것으로 본다. <개정 2018.12.18>
