민법 제1104조(유언집행자의 보수)

①유언자가 유언으로 그 집행자의 보수를 정하지 아니한 경우에는 법원은 상속재산의 상황 기타 사정을 참작하여 지정 또는 선임에 의한 유언집행자의 보수를 정할 수 있다.

②유언집행자가 보수를 받는 경우에는 제686조제2항, 제3항의 규정을 준용한다.
