민사소송법 제233조(당사자의 사망으로 말미암은 중단)

①당사자가 죽은 때에 소송절차는 중단된다. 이 경우 상속인ㆍ상속재산관리인, 그 밖에 법률에 의하여 소송을 계속하여 수행할 사람이 소송절차를 수계(受繼)하여야 한다.
